Delaware is set to kick off the licensing program for legal Cannabis sales in late 2024, becoming the 22nd state to legalize the use and sale of recreational Cannabis. This is a wake-up call for all Cannabis operators looking to tap into this goldmine of an opportunity.
Since the decriminalization of Cannabis in 2015, it took the state of Delaware another eight years to finally legalize the recreational use of Cannabis and to approve a bill to sell and tax the product. Legalization became effective on the 23rd of April, 2023, and since then, talks of issuing licenses have begun.

Delaware Cannabis Regulations
State Cannabis Overview: Delaware is the latest state in the US to legalize the recreational use of Cannabis and its sale. The bill was approved in April of 2023, and the product sale will commence around Thanksgiving of 2024.
The laws on the use, possession, distribution, and sale of Cannabis products remain similar across the country. Only adults ages 21 and above can carry one ounce of Cannabis in Delaware, as anything above that can is termed a misdemeanor.
Licensing: According to the Delaware Cannabis Policy Coalition, licenses will be issued by a Marijuana commissioner within the Division of Alcohol and Tobacco Enforcement. This body will also be responsible for regulating and inspecting Cannabis businesses to enforce compliance and safety across the state.
The state of Delaware will be issuing licenses for four types of businesses, including:
- Manufacturers
- Retailers
- Laboratories, and
- Cultivation facilities.
Delaware will be offering 125 licenses to Cannabis businesses 19 months after launch using a competitive and scored process that will go as follows:
- 60 cultivation licenses, including half for businesses with over 2,500 square feet and the other half for under 2,500 square feet. 20 of the total cultivation licenses will go to social equity applicants.
- 30 retail licenses: 15 of these will go to social equity applicants
- 30 manufacturing licenses: 10 of these will go to social equity applicants and 10 to micro businesses.
- Five (5) testing laboratory licenses: Two of these will go to social equity applicants.
