Kentucky Cannabis Regulations

State Cannabis Overview: Kentucky is the latest state in the US to legalize the use and sale of medical Cannabis. The bill was passed and signed into law in March of 2023. However, it is expected to take effect in 2025.

Kentucky is the 38th state in the US to legalize the use and sale of medical Cannabis. It is currently setting up a structure for businesses and strict regulations to guide the program. 

The laws are as you would expect or have seen with other states, including selling only to registered patients above 21, applying and acquiring a license to cultivate, produce, and sell the product, and more.

Licensing: The Cabinet of Health and Family Services will regulate the issuance of licenses (initial and renewal) and regulations of Cannabis businesses. The state is issuing Cannabis licenses to five kinds of Cannabis businesses, including the following:

  • Cannabis cultivators
    • Tier I: Indoor facility of 2,500 square feet
    • Tier II: Indoor facility of 10,000  square feet
    • Tier III: Indoor facility of 25,000 square feet
    • Tier IV: Indoor facility of 50,000 square feet

Kentucky has not set a limit to the number of licenses to issue, which provides a level playing ground for all business owners to apply for a license. It also creates room for a more open, competitive marketplace. 

However, it’s important to note that other regulations and criteria may still apply when obtaining a license, such as meeting specific quality standards, security requirements, or zoning restrictions.

Local Authority: Like many other states, local authorities in KY must further regulate the market in their municipalities and sanction businesses that don’t adhere to the regulations. Local authorities are authorized to enact ordinances that are in tandem with state Cannabis regulations provided by the Cabinet and to prohibit businesses within its territories.
