State Cannabis Overview: The Cannabis industry in Maine is relatively new and is set to become one of the largest markets in a few years. Recreational Cannabis use and sale became legal in the state in 2016, with sales kicking off in October 2020. The state levies a 10 percent tax on all retail Cannabis sales. It also allows Municipalities to impose further taxes on those sales.
Licensing: Maine uses a three-step licensing process for all kinds of Cannabis businesses, including conditional licensure, local authorization, and active licensure. Businesses are required to pass through all the stages to become fully licensed and operational.
The state of Maine will be issuing licenses for four types of businesses, including:
- Manufacturers
- Retailers (stores)
- Testing and research facilities, and
- Cultivation facilities.
All three steps can take you up to 200 days (or 300 days in some instances).
Local Authority: Municipalities (cities and towns) in Maine have the power to impose further restrictions and regulations on Cannabis businesses within their borders. They’re also given the right to impose additional taxes on operators, which can be up to three percent (3%) of all sales. Municipalities also have the authority to remove any business that doesn’t comply with the regulations or reject the construction of a business site.
