Massachusetts Cannabis Regulations
State Cannabis Overview: Massachusetts legalized medical Marijuana in 2012, allowing for the use of the drug by qualified patients for medical purposes. In 2016, the state moved to legalize recreational marijuana through a ballot initiative known as Question 4. However, it didn’t take effect until July 2017.
The industry has gradually and consistently grown over the years since sales launched and is projected to grow more than 50 percent higher in 2023 than in 2022. Adult-use Marijuana sales are subject to the following:
- A state sales tax of 6.25%
- A state excise tax of 10.75%, and
- A local option tax for cities or towns of up to 3%
Licensing: The Massachusetts Cannabis Control Commission is tasked with processing business applications and issuing licenses, creating Cannabis regulations on use and sale, and creating policies that promote full participation and healthy competition in the industry.
The state of Massachusetts offers 11 types of licenses to Cannabis businesses, including:
- Craft Marijuana Corporative
- Cultivator
- Independent testing laboratory
- Marijuana courier
- Marijuana delivery operator
- Marijuana research facility
- Microbusiness
- Product manufacturer
- Retailer
- Standards laboratory
- Transporter
The state has already issued final and provisional licenses to 156 retail businesses; more are in the pipeline to be finalized in the coming months.
Local Authority: Massachusetts allows local authorities to create regulations further guiding the state’s use and sale of the drug. Municipalities can restrict, ban, or approve of the establishment of a Cannabis business within their borders. They can also dictate the building structure, zoning regulations, licensing, etc.
Municipalities may also levy a tax of up to three percent (3%) on businesses within their localities.
