Mississippi recently began rolling out their first legal medical program in June of 2022. The state has no cap on the number of licenses it will issue. Localities were given the opportunity to opt out of the program with the ability to opt back in later. The deadline to do this was May of 2022. There has been a flurry of activity from prospective license holders since the state started accepting applications. There are state mandated setback requirements of 1500 feet from licensed dispensary locations, and 1000 feet from schools, churches and day care centers. The 1000 foot distance requirement can be reduced to 500 feet with a state provided waiver form signed by the sensitive use.
