Utah Cannabis Regulations

State Cannabis Overview: Utah legalized medical cannabis through the passage of Senate Bill 259, the Utah Medical Cannabis Act, in 2018. The law allows patients with qualifying medical conditions to access medical cannabis products. However, Utah has maintained strict regulations, including limitations on the types of cannabis products available and a prohibition on smoking cannabis flowers.

Licensing: The Utah Department of Agriculture and Food (UDAF) oversees the licensing and regulation of cannabis cultivation, processing, and manufacturing facilities. Dispensaries, on the other hand, are regulated by the Utah Department of Health. Both agencies have implemented strict guidelines to ensure product safety, security, and compliance with state laws.

The state offers four types of Cannabis licenses, including the following::

How many retail cannabis licenses are there in Utah?

There are currently 14 retail Cannabis licenses in Utah, all of which were issued in 2020. The state has paused license applications, and nothing has been heard to date about whether it would resume or not. All fourteen licenses were distributed among ten companies, including Curaleaf, Blom Medicinals, and Columbia Care.

How big is the Cannabis Market in Utah?

Utah is a relatively new Cannabis market in the US, only kicking off medical Marijuana Sales in 2020. The state only has 14 licensed Cannabis dispensaries across 14 of its 29 counties. However, regarding net sales of medical Cannabis, the state of Utah can be put up there with some of the older markets. 

The state recorded $74.8 million in Cannabis sales in 2021 and $118.7 million in 2022, growing up to 59% in one year. The market is projected to grow to $139 million by the end of the 2023 fiscal year.

California is widely regarded as the state with the largest cannabis market in the U.S. California’s market benefited from its early adoption of medical cannabis laws in 1996 and the subsequent legalization of adult-use or recreational cannabis in 2016.
